Summary / Abstract (Note) | The present study aims to target and analyse whether continuance of these newlineprovisions is constitutional and if claims for similar provisions by other states are made, would it be rational to extend to any of the states demanding? Or there must be some rationale basis for such extension or grant of special provisions to other states, even if their circumstances so warrant? Whether any alternative is possible to suggest in place of the provisions for improving and harmonizing inter-state relations for achieving the goal of unity and integrity of India? Both the hypothesis i.e. The special/temporary provisions under Articles 370 and 371 influence inter-state relations and affect the unity and integrity of India and there is an urgent need to revisit these Constitutional provisions for ensuring better and congenial inter-state relations and for overall peace and development of India which could be substantiated and proved in this study. However, a research gap is perceptible in the understanding the nature of Special Provisions under Article 371 pertaining to North-Eastern states and Temporary provision for State of Jammu and Kashmir under Article 370 of the Constitution. newlineThe study emphasizes that a lot of responsibility is there upon present political leadership and their focus must be upon the development of an agenda for national level growth rather than having many separate and split agendas of regional level development, as this is essential for keeping India together thereby securing its unity and integrity by following the footprints of our Constitution framers. newline |
